Protection of personal data.
In compliance with the provisions of current legislation on the Protection of Personal Data, we inform you that your personal data will be processed by NamGestion Financial Manager Luna 22 S.L., in its capacity as data controller, for the purpose of intermediating with credit institutions to obtain a mortgage and/or personal loan-credit in addition to the administrative, fiscal, accounting and billing management of clients.
Likewise, we inform you that your data will be communicated to Organisations related to the data controller; Banks; Financial Institutions; Central Risk Information Centre of the Bank of Spain (C.I.R.B.E.); et cetera., in order to be able to proceed with the purpose for which you provided us with your data.
In its capacity as agent for THE CLIENTS on their behalf or through their appointed representatives, THE INTERMEDIARY may:
- Communicate and transfer your personal data to financial and credit institutions and/or other companies in the financial sector, including other banking intermediaries, as well as insurance, real estate and energy supply companies.
- Also the consultancy firms associated with THE INTERMEDIARY, representatives appointed by THE INTERMEDIARY, lawyers, economists and professionals, collaborators necessary for the achievement of the object of this contract, as well as the different real estate lenders, appraisal companies and insurance brokers that collaborate with the.
- In compliance with Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights, and the European Data Protection Regulation (GDPR), all signatories are informed that their personal data may be processed by THE INTERMEDIARY, and incorporated and processed in its register of activities to carry out any action related to the service provided. Your data will be kept for commercial advertising purposes, as well as for automated processing of the same by means of expert system tools (scoring, data, mining, et cetera.) even after the end of the relationship, subject to your express consent. Your activity log will be kept for a legal period until deletion is requested, after which time it will be blocked for as long as necessary to respond to any legal, financial or tax claims.
- Upon request THE CLIENTS have the right to be informed of the persons and organisations to whom their data has been disclosed, provided that this right is not considered as an act of bad faith to obtain confidential information from THE INTERMEDIARY.
- THE INTERMEDIARY and the entities to which it communicates its data, may make enquiries about the credit history of THE CLIENTS with public (T.G.S.S.S, I.N.S.S, A.E.A.T, Land Registry and/or Commercial Registry) or private (ASNEF, BADEXCUG, EQUIFAX, ETC.), and especially before the Risk Information Center of the Bank of Spain (C.I.R.B.E).
- THE CLIENTS authorise the transfer of the data in order to proceed with the feasibility study and, in particular, to request information from the Risk Information CentER of the Bank of Spain (C.I.R.B.E.) to any financial and credit institution.
- The INTERMEDIARY shall at all times implement the security and privacy measures necessary to protect your personal data. THE INTERMEDIARY shall extend this duty of confidentiality to all its employees, collaborators and/or subcontractors, undertaking to adopt all necessary measures to ensure strict compliance with this confidentiality agreement, which shall survive even after the end of this contractual relationship.
THE CLIENTS undertake that the data and documents containing them provided to THE INTERMEDIARY for the execution of the assignment are truthful and have been legitimately obtained.
THE CLIENTS grant their authorisation to offer them products or services related to those requested, to carry out the automated processing of the same by means of expert system tools (scoring, data, mining, etc.) even after the contractual relationship has ended, as well as to increase customer loyalty by sending them offers and promotions via email, sms, fax, post, etc.
THE CLIENTS have the rights recognised in the current data protection regulations, being able to access, rectify and delete their data, request the portability of the same, oppose the processing and request the limitation of the same at any time.
Thus, the client has the right to access their personal data and to obtain a copy of the personal data undergoing processing, to update it, as well as to request the rectification of inaccurate data or, where appropriate, to request its deletion when, among other reasons, the data is no longer necessary for the purposes for which it was collected. In certain circumstances provided for in Article 18 GDPR, data subjects may request the limitation of the processing of their data, in which case the data will only be kept for the purpose of exercising or defending claims. As a consequence of the application of the right to erasure or objection to the processing of personal data in the online environment, data subjects have the right to be forgotten as established. The client may object to the processing of his data for marketing purposes.
